I’ve been doing some research on Flock cameras. Here’s what I found.<\/p>\n

A camera probably took a picture of your license plate today. It saved where you were, what you drive, what time you passed, and even the dents and bumper stickers on your car. You didn’t do anything wrong. It kept the picture anyway.<\/p>\n

The cameras are made by a company called Flock Safety. Flock runs more than 80,000 of them across 49 states, under contract with more than 5,000 police agencies. The Shelby County Sheriff’s Office uses them. So do departments in big cities and small towns all over Tennessee. The company says its cameras read plates more than 20 billion times a month.<\/p>\n

These cameras have good uses – they find stolen cars and missing people, and they’ve helped close shootings and homicides when all a witness could give was a white SUV. If the story ended there, I wouldn’t be writing this.<\/p>\n

Every picture goes into a searchable database, and most agencies share their cameras into a national network. A police department three states away can search the cameras on your street. There’s no warrant and no judge involved. An officer types a plate number and a reason into a box, and the system hands over months of your movements.<\/p>\n

Audit logs pulled by reporters show what happens when nobody checks that box. Police officers have used these cameras to stalk women. In Kansas, cops tracked a man because he wrote a column criticizing their department. And here at home, an audit reviewed by the Nashville Scene showed Memphis police ran searches on the Flock network tagged “ICE,” “Wanted by DHS,” and “HSI” – local cameras, paid for by local taxpayers, feeding federal immigration sweeps.<\/p>\n

Both parties own this one. Denver’s city council voted to kill its Flock contract, and the city’s Democratic mayor extended it anyway. Cities red and blue keep signing up because the pitch sounds like free crime-solving and nobody reads the part about who else gets the data.<\/p>\n

Tennessee does have a plate camera law. It’s one page long, passed in 2014, and it says the data can’t be stored more than 90 days. That’s the whole law. Flock didn’t even exist until 2017. The rule assumes a police department with a few cameras of its own. It says nothing about warrants, who gets to search, or sharing your data out of state.<\/p>\n

Congress has passed nothing at all to address this. There is no federal law on license plate readers.<\/p>\n

Meanwhile, the FBI is preparing to spend $36 million on a nationwide plate reader system that can track any car in near real time.<\/p>\n

Then there’s Texas. A woman there took abortion pills. A sheriff’s deputy went looking for her and searched more than 83,000 of these cameras across the country, including cameras in states where abortion is legal. The reason he typed into the system was “had an abortion, search for female.”<\/p>\n

The sheriff claimed his office was just checking on her safety. Court records later showed they were investigating the death of the fetus and asked the district attorney that same day if they could charge her.<\/p>\n

Nobody’s fixed this yet, but somebody’s trying. Rep. Scott Perry, one of the most conservative Republicans in Congress, and Rep. Chuy Garc\u00eda, one of the most progressive Democrats, have proposed an amendment to the highway bill that would restrict these cameras to toll collection and nothing else. It hasn’t passed. It’s just sitting there, waiting on a vote. But when those two agree on something, it’s usually because the thing really is alarming.<\/p>\n

Here’s what I would do – let police keep the cameras for chasing stolen cars and finding missing kids. But make searching months of stored data about one person require a warrant. Make the data get deleted fast. And shut the back door that lets federal agencies raid local camera networks.<\/p>\n

We require one before the police search your house. Following your car for three months is a search, too.<\/p>\n
