So – I see people are actually starting to pay attention to who gets to see their private data! Awesome! Cause I can talk about this all day!<\/p>\n

I’ll start by restating my stance on private data: You should have to opt in to any use of it – and you should be paid if someone uses it. It’s the same stance I have about anyone’s work being used to train AI.<\/p>\n

Now check this out…<\/p>\n

It recently came out that Honda sold four years of driving data from 97,000 cars, and Hyundai moved data from 1.7 million cars. What data did they sell? Your hard brakes and fast starts.<\/p>\n

The data came out of programs with friendly names like Smart Driver and Driving Score. Dealers pitched them as safety features that could earn you an insurance discount.<\/p>\n

Honda drivers had to enroll through the company’s app, but the disclosure that their data would go to a broker was buried in lengthy terms. Hyundai went further – it automatically enrolled drivers who activated their car’s internet connection without clearly telling them. Two Senators dug into the paperwork and accused the companies of using dark patterns, which are design tricks that steer you into clicking yes.<\/p>\n

The buyers were data brokers – LexisNexis and Verisk – and the brokers’ customers were insurance companies.<\/p>\n

The contracts didn’t limit insurers to using the data for discounts. The New York Times told the story of a Seattle man whose rate jumped 21 percent. He requested his file from LexisNexis and received 258 pages covering 640 trips, including start times, distances, hard braking, and speeding.<\/p>\n

His own car had built the case against him.<\/p>\n

The Times also reported on a Florida man turned down by seven insurers before he learned his Cadillac had been reporting on him through an app he says he never enrolled in.<\/p>\n

GM got caught first, thanks to that same Times investigation in 2024.<\/p>\n

California prosecutors say GM made about $20 million selling this data. The fallout has been real. GM killed the program and cut ties with both brokers. This past January, the FTC finalized an order banning GM from giving driving data to consumer reporting agencies for five years, with consent and deletion rules that run twenty.<\/p>\n

California’s attorney general, its privacy agency, and a group of district attorneys settled with GM for $12.75 million in May. Texas and Nebraska have sued, and GM faces private lawsuits around the country. In April, a federal judge allowed major portions of a class action covering roughly 16 million drivers to move forward, including some wiretapping claims.<\/p>\n

Now here’s the part that I want to make sure you understand. Every one of those punishments is a fine – and the FTC order binds one company because it deceived people.<\/p>\n

There is still no comprehensive federal law requiring every automaker to get clear opt-in consent before collecting or selling your driving data. Nothing stops the next automaker from running the same play with better fine print. And according to the Senate investigation, only two states – Louisiana and Montana – prohibit insurers from using this data to raise your premiums.<\/p>\n

Tennessee is not one of them.<\/p>\n

To be fair about it, telematics done honestly can be a good deal. A careful driver who knowingly opts in can earn a real discount, and that’s a legitimate trade. The scandal isn’t that the data exists. It’s that people never agreed to it.<\/p>\n

In this district, we drive. Long commutes, rural highways, gravel roads, and busy interstates. A hard brake in your file doesn’t say whether you were driving recklessly or dodging a cat. But the number goes in the report either way, and nobody has to tell you the report exists.<\/p>\n

The fix writes itself, because the FTC already wrote it for one company.<\/p>\n

Congress should take the GM order and make it the law for every automaker: no collecting or selling driving data without clear opt-in consent, the right to see your file, and the right to delete it. And if they plan to sell it – you should get a cut.<\/p>\n

While we wait on Washington to write a law, you can request your own files.<\/p>\n

LexisNexis<\/a> and Verisk<\/a> both have to show you what they have on you, free, under federal credit reporting law. The request takes a few minutes. Getting the report back takes longer, but it’s worth knowing what’s in your file before your insurer does.<\/p>\n
